You confirm that you have read and understood our Terms and Conditions and you agree to be bound by them.
- Introduction. These Terms and Conditions apply to the creation of an account with Talking Tourist, and for the purchase of lessons booked through the Talking Tourist platform (www.talkingtourist.com), which is owned and operated by Talking Tourist LTD, 86-90 Paul Street, London, England, EC2A 4NE. By creating an account with Talking Tourist, you agree to be bound by these Terms and Conditions. If you refuse to accept these Terms and Conditions, you will not be able to purchase lessons on the Talking Tourist platform.
- Signing up. By creating login details with Talking Tourist, you agree that you are happy to receive service updates on your lessons booked, upcoming lessons and any changes to your lessons. You agree to receive messages from teachers (within the platform talkingtourist.com) regarding your lessons.
- Minimum age requirement to use the Talking Tourist platform. You must be aged 18 or over to use the Talking Tourist platform. By agreeing to these terms and conditions you are confirming you are over 18.
- Booking a lesson
- Lesson price and lesson package discounting
- The lesson price is set by Talking Tourist LTD and varies by teacher to fit your budget. The price will be visible both within each teacher's individual profile, and throughout the booking process before payment.
- Prices displayed are price per single lesson (each 50 minutes in length). A discount is applied when multiple lessons are purchased as part of a package. This can be viewed on our Pricing page.
- These prices and discounts may be subject to change at our discretion.
- Purchasing lesson packages. If you have purchased a lesson package (a lesson package is anything over 1 single lesson), all lessons other than your first one booked during the booking process will appear in your dashboard and will display as ‘purchased lessons’. You can schedule these purchased lessons with a teacher at your time of choosing. Once you have selected an available date and teacher for your lesson, the display within your dashboard will change from a ‘purchased lesson’ to show as a ‘booked lesson’. For example, if you had 2 purchased lessons displaying, once you have scheduled in a time and date then it will show as 1 booked lesson and 1 purchased lesson in your dashboard, which means you have 1 remaining lesson to schedule in.
- Expiry date on lessons purchased. Lessons purchased have an expiry date of 3 years. You will receive a service message reminder 6 months prior to the expiry date. You can request that this date be extended if you are unable to use them within that time frame by emailing hello@talkingtourist.com. It is completely within Talking Tourists discretion to extend the timeframe or not, and it is under no obligation to do so.
- Lesson price and lesson package discounting
- Lesson requirements
- Lesson length. Each lesson is 50 minutes in length. This allows teachers to take a break between lessons, and this must be respected if the teacher is trying to conclude the lesson at 10 to the hour.
- Lesson start and finish time. Lessons start on the hour e.g., 1.00pm and finish ten to the hour e.g., 1.50pm.
- Reviewing a lesson. At the end of your lesson, there will be a pop-up feedback box to give your teacher a rating (out of 5 stars, 5 being the highest and 1 the lowest rating), and the opportunity to write feedback on the lesson. This will be displayed on their profile and will show your name unless you decide to select the box to post your review anonymously. If you have any issues with your teacher that you would prefer them not to see, and wish to be resolved, please email hello@talkingtourist.com titled ‘Feedback for [teacher name]’ and we will respond to you regarding your feedback.
- Late for a lesson
- You are running late and have notified the teacher within the first 15 minutes: If you are late for a lesson then this cuts into your own lesson time. Please notify the teacher at the earliest opportunity via the message option within the platform. It is at the teachers’ discretion as to whether they extend the lesson for you. Please note, if they have another lesson following yours or other commitment, they may not be able to do this.
- You are running late by more than 15 minutes and did not notify the teacher. If you join the lesson more than 15 minutes late and have not notified the teacher of this, this will be classed as a missed lesson, and you will not receive a refund on your lesson or be able to reschedule this. The teacher will wait until 15 minutes before dropping off the lesson. If you have not notified the teacher, they are not required to re-join the lesson.
- Teacher is late and has notified you via the platform messaging service within the first 15 minutes. If the teacher is late, they can contact you via the platform. You will receive an email to notify you that you have received a message from your teacher. Please join the lesson and wait for your teacher to arrive. Once they have arrived, you can agree with them on whether to extend the lesson to make up for the time lost or reschedule the lesson for another time. Please speak to the teacher, or alternatively email hello@talkingtourist.com with details and we will get back to you on the best course of action to resolve.
- Teacher is late by more than 15 minutes and has not notified you that they are late. If your teacher is late by more than 15 minutes and were not able to notify you of this beforehand, then this is classed as a teacher no show. After 15 minutes you may leave the lesson and either reschedule with another teacher or receive a full refund on your lesson. Please email hello@talkingtourist.com with details and we will get back to you on the best course of action to resolve.
- Rescheduling a lesson
- You need to reschedule a lesson and there is more than 24 hours before the lesson is due to take place. Please send the teacher a reschedule request via your customer dashboard using the ‘reschedule’ button on the lesson you wish to reschedule. You will be able to select a new date and time that your teacher is available for. If you are unable to make a date within the next 2 weeks, please see (section 8) on postponement of a lesson.
- You need to reschedule a lesson and there is less than 24 hours before the lesson is due to take place. You are unable to reschedule a lesson if it is less than 24 hours until it is due to start. You will need to select ‘cancel’ on your lesson within the dashboard to let your teacher know. If you do not inform the teacher, they will join the lesson and wait for 15 minutes before it will be classed as a no show and they will be able to leave the lesson. The teacher will receive full payment for the lesson and will not be expected to reschedule the lesson. If you need to cancel due to exceptional circumstances, please email hello@talkingtourist.com with the reason why you need to cancel.
- Teacher needs to reschedule a lesson more than 24 hours before the lesson is due to take place. You will receive a reschedule request in your inbox where you will be able to select a new date and time for your lesson. The teacher will also message you to make sure you have received the request.
- Teacher needs to reschedule a lesson and there is less than 24 hours before the lesson is due to take place. The teacher is unable to reschedule and will need to cancel the lesson. You will receive a cancellation email from the teacher. We will aim to get you a replacement teacher for the same time where possible or book in a new time for you. If you have future lessons booked in with the teacher who cancelled the lesson, it is your choice whether you wish to continue with the same teacher or select another one.
- Rescheduling the lesson due to technical difficulties. If you or the teacher are unable to join or continue a session due to technical reasons, the teacher will reschedule the session with you. Please contact hello@talkingtourist.com if you believe it to be an issue with the lesson software and not either your or the teacher's internet connection or other technical issues and we will look into this and get back to you.
- Postponing a lesson. If you are able to reschedule your lesson more than 24 hours before it is due to take place, but are unable to reschedule your lesson for a future date (due to unforeseen circumstances e.g. family or personal illness) then please send the teacher a cancellation request through the customer dashboard and email hello@talkingtourist.com to inform us so that we can book you in for another lesson when you are able to do so.
- Changing a teacher
- If you feel that a teacher is not meeting your requirements, or is not the right fit for you, you can book a lesson with an alternative teacher without penalty.
- If you are unsatisfied with a lesson you have already had with a teacher, you can contact hello@talkingtourist.com to come to a resolution.
- Payment policy
- Making a payment. Payment is required upfront and in full for all lesson packages purchased prior to the lesson or lessons taking place.
- Accepted payment types. PayPal or card payment via Visa, Mastercard, American Express, or Discover.
- Payment processing methods. Via Debit or Credit card payment if Visa, Mastercard, Discover, or American Express card. Via your bank account if connected to PayPal, or via your PayPal credit.
- Refunds
- When you can receive a refund
- You can request a full refund for any lessons you have purchased that have not yet been booked in with a teacher. These will show in your dashboard as ‘Purchased lessons’.
- If your teacher is more than 15 minutes late to your scheduled lesson and you cannot agree on a rescheduled time with them, and do not wish to book with an alternative teacher you can request a full refund.
- If you feel unsatisfied with the service provided by the teacher, or that your requirements have not been adequately met. Please contact hello@talkingtourist.com in the first instance to see if we can resolve your issue. If it cannot be resolved through the same or another teacher, we can provide a full refund.
- As a consumer you have the right to cancel and claim a refund without needing to provide reason or rationale, within 14 calendar days. This is applicable 14 calendar days from when you have booked a lesson in.
- When you cannot receive a refund
- If your lesson has already been booked in with a teacher for a date & time, then your only options are to reschedule the lesson (if there is more than 24 hours until the lesson start time) or cancel your lesson (if there is less than 24 hours until the lesson start time). See the reschedule section (section 7) for further details.
- Where your account has been removed due to one of the reasons outlined in the rules section (section 12), you will not receive a refund for purchased lessons.
- If your lesson takes place within 14 days of booking it, this will be taken as you choosing to ‘consume’ the service via absorbing the learning resources shared with you via the teacher both verbally and through materials shared. Therefore, from the date of your lesson, or once 14 days have passed since booking you are no longer able to cancel without reason and receive a refund.
- When you can receive a refund
- Talking Tourist member rules. Members of Talking Tourist must adhere to the following rules in order to remain using the services of Talking Tourist. Any members who break these rules, their profile will be removed from the platform and no refund will be given for outstanding lessons purchased.
- Be polite to your teacher, do not be rude or use any derogatory language towards them.
- Do not request any personally identifiable information from teachers such as date of birth, gender identification, age, religion, sexuality, phone number, home address.
- Do not use any personal video or audio recording devices to record a lesson or take pictures of your screen if the teacher's camera is on without the permission of the teacher prior to doing so. Lesson resources can be shared afterwards with you.
- You must provide information to your student profile that is accurate, fair and not misleading.
- You should not request teachers to have lessons with you outside of the platform. If the teacher is suggested this, please let us know at hello@talkingtourist.com
- Do not use any hate speech in lessons or within your reviews towards teachers.
- Respect start and end times of lesson booking. Lessons are 50 minutes long, please try to not be late to lessons, as your teacher will most likely have another lesson to teach after yours and it will therefore be difficult for them to extend your time. The lesson ends at ten minutes to the hour. Please respect this and allow your teacher to finish the lesson on time, to allow them a break before their next lesson begins.
- If you fail to meet any of these requirements, Talking Tourist LTD reserves the right to remove you from the platform, cancel any future booked lessons, and if necessary, seek legal remedies.
- Teacher misconduct. If a teacher speaks to you in a derogatory way, please report this immediately to hello@talkingtourist.com to be dealt with in a sensitive manner. Please end a lesson early if you are uncomfortable with anything said by a teacher.
- Termination of Services. If you wish to cancel your customer profile, you can do this at any time. Contact hello@talkingtourist.com and we will delete your profile. We require a 1-month notice period to enable us to fulfil this for you. During that time, you cannot schedule any further lessons with your teacher once notice has been given. Any outstanding lessons you have scheduled that are due to take place within the 1-month cancellation notice period can be taken. If your lessons are scheduled for after your profile expires, the value of these will be refunded to you. Any lessons purchased as part of a package which have not yet been scheduled with a teacher will also be refunded to you.
- Talking Tourists right to terminate your account. We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.

- You may not copy, reuse, repost or sell the materials provided by Talking Tourist teachers for any public or commercial purpose without their prior consent. Content provided by teachers is for your personal use only.
- Use of lesson recordings. We do not record audio or video for the lessons without prior consent to do so. We do record tab contents (whiteboards, documents etc) and chat conversations for the purpose of tracking teacher and student attendance to a lesson when it is required (if either party are late) and ensuring the quality of the lessons.
- Notification of T&C changes. Talking Tourist LTD reserves the right to change these terms and conditions at any point of time in the future. Where there are significant changes to pricing or other key terms, you will be made aware of these on our homepage or via email. If there are any changes to how we use personal data, those affected by the change will be notified by email. It is advisable that you read the terms and conditions on a regular basis. By continuing to use the platform (talkingtourist.com), this confirms that you accept any changes to terms and conditions
- Liability and warranties
- To the fullest extent permitted by applicable laws, we disclaim responsibility for any harm resulting from your use of all or any part of the platform, site and/or Services. We shall not be liable to you for platform failure, any indirect, consequential, special, exemplary, incidental or punitive damages, including lost profits, whether such claim is based on warranty, contract, tort or otherwise (even if we have been advised of the possibility of such damages)
- The purpose of our website and services is to connect teachers and students and facilitate direct bookings of lessons between them. We only provide connection and payment services and are not responsible for any methods, materials, online delivery tools, or any other aspect of the lessons or teaching services. Any payment made or accepted through our site will be done so at your own risk. We shall not be liable for the conduct of the language teachers and do not guarantee the quality, availability, accuracy, or legality of the teaching services advertised, the qualifications or background of the teachers, or the ability of teachers to deliver teaching services. If you are dissatisfied with a service, get in touch with Talking Tourist LTD who will endeavour to support you to a positive resolution, this may involve resolutions such as a change of teacher or a refund, however this is purely at the discretion of Talking Tourist LTD.
- If, notwithstanding the other provisions of these Terms, we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the platform, site and/or any of the services, our liability shall in no event exceed the lower of (1) the total of any fees with respect to the Services, or (2) £100.00.
